Terms & Conditions
These terms set out the basis on which Tawan Trust offers its financial education programmes. We have written them as plainly as we can. If anything is unclear, please reach out before enrolling — we are always glad to talk things through.
1. Definitions
Throughout these Terms, the following words carry specific meanings:
- "Agreement" means these Terms & Conditions together with any enrolment confirmation.
- "We", "Us", "Our" means Tawan Trust, operating at 27/9 Thanon Thalang, Talat Yai, Muang, Phuket 83000, Thailand.
- "You", "User", "Participant" means any person who accesses our website or enrolls in a programme.
- "Service" means any financial education programme, session, or material offered by Tawan Trust.
- "Content" means all materials, guides, worksheets, recorded sessions, and written resources we provide.
- "Programme" refers to any of our named courses: Wading In, Finding Your Depth, or The Far Horizon Programme.
2. Acceptance of Terms
By accessing our website, making an enquiry, or enrolling in any programme, you confirm that:
- You are at least 18 years of age and have the legal capacity to enter into this Agreement.
- You have read, understood, and agree to these Terms in full.
- If you are acting on behalf of another person, you have the authority to bind them to these Terms.
If you do not agree with any part of these Terms, please do not proceed with enrolment. We are happy to discuss any concerns before you commit.
3. Service Description
Tawan Trust provides financial education programmes designed for adults aged 40 and above. Our programmes are educational in nature and are delivered in English in Phuket, Thailand. We currently offer three programmes:
Wading In — ฿4,600
A gentle three-session introduction covering budgeting, saving, and everyday Thai banking basics.
Finding Your Depth — ฿6,700
A six-week course exploring saving, funds, deposit options, and personal financial planning.
The Far Horizon Programme — ฿10,300
A ten-week guided programme addressing retirement planning, pensions, and longer-term family security.
Programme schedules, group sizes, and delivery formats may vary. We reserve the right to adjust session timing or delivery method where necessary, with reasonable notice to participants.
4. Enrolment & Accounts
Enrolment is confirmed upon receipt of payment in full. By enrolling you agree to:
- Provide accurate and complete personal information at the time of registration.
- Notify us promptly if any of your details change.
- Not share programme access, materials, or login credentials (where applicable) with third parties.
We may decline an enrolment at our discretion, in which case any payment received will be refunded in full.
5. User Responsibilities
As a participant, you agree to:
- Treat fellow participants, facilitators, and staff with courtesy and respect.
- Attend sessions with reasonable punctuality and engage in good faith.
- Use all materials and content for personal, non-commercial purposes only.
- Refrain from recording, reproducing, or distributing any session content without written permission.
- Not disrupt the learning environment or misrepresent your identity or qualifications.
We respectfully ask that participants approach sessions with openness. There are no expectations of prior financial knowledge — only a willingness to learn at a comfortable pace.
6. Intellectual Property
All content produced by Tawan Trust — including guides, worksheets, recorded sessions, written materials, and programme frameworks — remains our intellectual property. Upon enrolment, you receive a limited, non-transferable licence to use these materials for your own personal learning only.
You may not copy, adapt, publish, sell, or otherwise distribute any programme content without our prior written consent. This restriction applies during and after your enrolment.
7. Payment Terms
All programme fees are quoted in Thai Baht (฿) and are payable in full prior to the start of your first session unless we have agreed an alternative arrangement in writing.
Payment methods: Bank transfer, cash, or such other methods as we may notify from time to time.
Receipts: A written confirmation will be issued upon receipt of payment.
Cancellation by participant: Cancellations made more than 7 days before the programme start date are eligible for a full refund. Cancellations within 7 days of the start date may be eligible for a credit toward a future programme, at our discretion.
Cancellation by Tawan Trust: If we cancel a programme, you will receive a full refund or the option to transfer to an alternative date.
Non-attendance: Fees are not refunded due to non-attendance, unless cancellation was made within the period described above.
8. Course-Specific Terms
The following apply to all Tawan Trust programmes:
- Completion: Certificates or letters of participation may be issued upon completion of the full programme. Partial attendance does not qualify for completion recognition.
- Recorded materials: Where sessions are recorded (Finding Your Depth), access to recordings is provided for personal review only and is not transferable.
- Group sessions: Small-group programmes are subject to minimum and maximum participant numbers. We reserve the right to reschedule if minimums are not met, with reasonable notice.
- Academic integrity: Materials and exercises are for your own learning. Submitting another person's work as your own, or assisting others in doing so, may result in removal from the programme without refund.
- Professional advice: Our programmes are educational. They do not constitute financial, legal, or investment advice. We always encourage participants to consult a licensed professional before making any financial decisions.
9. Disclaimers
Our programmes are offered as educational resources. We make no representation that participation will lead to any particular financial outcome. Financial circumstances vary greatly between individuals, and learning about money management does not remove the need for personalised professional guidance.
Our website and materials are provided in good faith and on an "as is" basis. While we take care with the accuracy of our content, we do not warrant that all information is complete or current at all times. Regulations and financial products in Thailand may change, and we recommend verifying important details with an appropriate professional.
Any links to external websites or resources are provided for convenience only. We are not responsible for the content, accuracy, or practices of third-party sites.
10. Limitation of Liability
To the fullest extent permitted under Thai law, Tawan Trust shall not be liable for:
- Any indirect, incidental, or consequential losses arising from your participation or non-participation in our programmes.
- Financial decisions made by participants as a result of, or in reliance on, programme content.
- Interruption, postponement, or cancellation of sessions due to circumstances beyond our reasonable control (force majeure), including natural events, public health measures, or utility failures.
Where liability cannot be excluded by law, our total liability to you shall not exceed the fees paid for the programme in question.
11. Indemnification
You agree to indemnify Tawan Trust and its facilitators against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of programme materials, or any unlawful conduct during your participation. This obligation survives the end of your enrolment.
12. Termination
By you: You may withdraw from a programme at any time. Please see Section 7 for the applicable refund or credit terms.
By us: We may ask a participant to leave a programme if their conduct is disruptive, disrespectful, or in breach of these Terms. In such cases, we reserve the right to withhold a refund.
Survival: Sections relating to intellectual property, disclaimers, liability, indemnification, and dispute resolution continue to apply after the end of your enrolment.
13. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be subject to the jurisdiction of the courts of Phuket Province, Thailand.
We would always prefer to resolve concerns informally and in good faith before any formal process. If you have a concern, please contact us at [email protected] and allow us 14 days to respond.
Where informal resolution is not possible, we are open to mediation as a first step before any legal proceedings.
14. General Provisions
- Entire agreement: These Terms, together with any enrolment confirmation, represent the complete agreement between you and Tawan Trust in relation to our programmes.
- Severability: If any part of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure by either party to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not transfer your enrolment or rights under these Terms to another person without our written consent.
- Notices: We will communicate with you using the contact details you provided at enrolment. Notices sent by email are considered received on the day of transmission.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our programmes or in applicable law. When we do, we will revise the "Last Updated" date at the top of this page and, where changes are material, we will notify enrolled participants by email.
Continued participation in a programme following notification of changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you may withdraw in accordance with Section 7.
